Purchase agreement

For orders made at www. www.gabrielamunagorri.com the purchaser`s contract partner is: CIF. 44149009, Spain. The presentation of products in our online shop is not a legally binding offer, but a non-binding online catalogue. By clicking on the “Send Order” button, you make a binding order for the products in the shopping basket. The confirmation of receipt of your order along with the acceptance of your order occurs after the order is made by the display of an order confirmation and by an additional copy by means of automated email. The purchase agreement is made when this confirmation is shown. We reserve the right in exceptional cases (for example, in the event of unavailability of the goods) to rescind the order. In such cases, we will notify you immediately and, where appropriate, may propose alternatives.

Orders (Spain)

We deliver by courier directly to your home. Deliveries to PO boxes and/or post restante deliveries are not possible. The fixed fee for handling:

Packaging and domestic delivery (Spain) is aproximatly, EUR 8.50. Incoming orders are usually processed and shipped by us within 24 hours. Our shipping partner generally delivers the ordered goods in the national territory in 24-48 hours. Experience shows that deliveries to remote areas or islands take 4-5 days longer. To provide you with your order as quickly as possible and without incident, our shipping partner requires a telephone number where you can be reached during the day (see required field in the shopping basket). Furthermore, it is helpful if you provide a shipping address where you or a trusted person is generally available. Orders will only be delivered if previous orders have been paid. The product(s) remain(s) the property of There srl until full payment has been made.

Orders from EU Member States

We currently deliver to the following countries. Please ask for the corresponding shipping costs. Any applicable customs fees or other fees for deliveries to non-EU countries are specifically at the expense of the customer. Deliveries are made to non-EU countries by prior arrangement only. Please contact us in such cases at estudio@gabrielamunagorri.com . Note: Our online store is currently available in English. We expressly point out that we are not liable for any misunderstandings that might arise due to a lack of language skills.

We deliver directly to your home. Deliveries to PO boxes and/or post restante deliveries are not possible.

Shipping in Spain is free of charge for orders over EUR 120. Shipping to EU countries is free of charge for orders over EUR 170. We reserve the right to effect partial deliveries. Except in cases where the contrary is stated.

Delays in delivery and non-availability of the goods

This online shop is directly connected to our logistics department. Therefore, we are able to show you the current availability of the individual items immediately. In exceptional cases, however, delays in delivery may occur or the desired goods may not be available. In such cases, we shall inform you accordingly without delay. We reserve the right to effect partial deliveries. Incoming orders are usually processed and shipped by us within 48 hours.

Rights of revocation and returns

You are entitled to rescind the contract within 7 days without specifying the reasons. In order to report your rescission of the contract, you are requested to send us an email to estudio@gabrielamunagorri.com We would be grateful to receive a brief indication of the reasons for your withdrawal from the contract to enable us to improve our service. The right to terminate the contract commences from the date when the goods are delivered. Rescission of the contract of purchase shall not be possible if the goods have been damaged in any manner by the consumer (e.g. soiled goods, etc.). Please do not remove the labels from the goods until you are certain that you wish to keep the goods. Your right to receive additional promotional products shall be rendered void when you rescind the contract, and these goods must be returned. We reserve the right to only accept your rescission of the contract if the goods have been returned in their original condition (including sales and shipping packaging).

Damage in transit

You are requested to check the contents of the consignment immediately upon receipt in order to determine that the shipment is complete and undamaged. Should the package be damaged, please file a complaint with the postman immediately. Please also always contact us using the online form.

Payment

We offer the following payment options:

  • Credit card (Visa, Mastercard ). The invoiced amount is debited at the moment the package is transferred to the shipping company.

o  Please do not try to pay by any other way than specified there. If you do, we will not be liable for loss of the payment or any other damages that may result from this action.

  • Prices / Payment / minimum order value / prices

All prices shall apply, as a matter of principle, at the time when the order is placed. Unless otherwise mentioned, the prices refer to the articles illustrated in each case in accordance with the description. However, they do not refer to contents, accessories and/or decoration. Errors and price changes excepted. All prices are final prices and include 21 % VAT. Shipping costs are not included in the prices indicated. Please refer to the appropriate table for shipping costs. We shall, until further notice, proceed according to the “country of origin principle”, i.e. we charge the VAT rate of the country of origin (Spain) within the EU.

The product prices displayed on the Website are inclusive of Value-Added Tax (VAT). Shipping rates are applied per order. The exact shipping rates depend on the country where your order is being delivered to. For details on shipping rates per country ask in estudio@gabrielamunagorri.com

  • Prices are quoted in Euro. Please note that changing the country of delivery may have an influence on the price due to a change in currency or to country specific pricing.
  • The price will be recorded in the Order Confirmation, which we recommend you print or download for future reference. If paying by credit card, the total amount for your entire order will be reflected on your statement in your local currency. If your local currency is different from the currency in which the prices are quoted, your bank will apply the exchange rate applicable per the date of purchase. Your bank may apply a different exchange rate, which is beyond our control. When you paid with transfer. Please transfer only the exact amount specified on the Order Confirmation, and make individual transfers per order, using the unique reference number stated in your Order Confirmation.
  • Price changes
  • The prices of the products will be as displayed on the Website. Prices may change from time to time, but changes will not affect any order which we have confirmed in an Order Confirmation.
  • Shipping & Delivery

We deliver products from Monday to Friday. We do not ship on certain public holidays. We can only fulfill an order to a delivery address which is a home or office address.

Returns & Cancellations

Inspectio upon delivery

  • Upon delivery, please inspect the packaging for damage. If it appears that the products are damaged, please do not accept the shipment.

Cancelling order before delivery

You may cancel any order s free of charge and without giving us any reason, provided it has not yet been shipped. We begin processing orders placed at our online store almost immediately. If you wish to cancel your order, please check the status of your order first by sending an email to estudio@gabrielamunagorri.com If the status of your order is “Pending” you may cancel your order by contacting our by email estudio@gabrielamunagorri.com when we will request a cancellation of your order at our warehouse. If successful, they will send you an email and the cancellation will be free of charge. If cancellation is not possible, the product(s) will be delivered to you and may be returned in accordance with the procedure set out below.

Returning orders after delivery

You are entitled to return products delivered to you in the event that they are defective not in conformity with your order when you received them. You can do so within 7 days after you notice the defect. This does not affect your statutory rights. In the event your claim is justified, the purchase price and the shipping costs will be refunded.   • Intellectual property rights
  • Gabriela Muñagorri owns all intellectual property rights in the Website and in the material published on it. Those works are protected by copyright laws around the world. All such rights are reserved.
    • You may print off one copy, and may download extracts of any page(s) from the Website only to the extent this is necessary for the purpose of placing an order with us, or for using the Website as a shopping resource.
    • You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
    • Gabriela Muñagorri´s status as the owner of content on the Website must always be acknowledged.
    • You must not use any part of the content on the Website for commercial purposes without obtaining a license to do so from Gabriela Muñagorri.

If you print off, copy or download any part of the Website in breach of these general conditions, your right to use the Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

  • These general conditions and all disputes arising in connection with these general conditions, including the validity thereof, or with the use of the Website(s) or with any purchases on the Website shall be governed by Spanish law.
  • Aviability of the website

We do not guarantee that the Website, or any content on it, will always be available or be uninterrupted. Access to the Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Website without notice. We will not be liable to you if for any reason the Website is unavailable at any time or for any period.

  • The Website provides links to external Internet sites. We shall not be liable for the use or the content of internet sites that link to this site or which are linked from it.

Variation of general conditions

We may revise these general conditions from time to time. Every time you order products from us, the general conditions in force at that time will apply to the contract between you and us.
Whenever we revise these general conditions we will keep you informed and give you notice of this by stating that these general conditions have been amended and the relevant date at the top of this page.

Other important terms

  • Each of the paragraphs of these general conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

Deletion of your data / Data protection

If you are registered with us and no longer wish this to be the case, please fill out the online form. We will then delete your data immediately and refrain from further mailings. You can also cancel by sending an email to estudio@gabrielamunagorri.com with a copy of your CIF.

  • Retention of your data: We retain your personal data for as long as necessary to fulfil the purposes for which we collect it, except if required otherwise by law.

We shall only collect data from you which is required for the execution of the order and the handling of the contract. You are entitled to request information regarding the status of your data at any time as well as the amendment or deletion of your data, or to object to the processing of your data. Your order data is not accessible via the Internet for security reasons. The disclosure of your personal details is voluntary. Should you wish to refuse to furnish us with your personal details, we shall be unable to render the services you requested.

You may rest assured: We do not pass on and/or sell your details to third parties for marketing purposes. Your details are passed on to our forwarding agent for shipping purposes.

  • OUR RIGHT TO REJECT YOUR ORDER OR CANCEL A CONTRACT
  • Fulfillment of all orders on the Website is subject to availability. We explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel a Contract by written notice to you in the following situations, without being liable for any damage or costs other than repayment of any amount received from you in relation to the Contract we have cancelled:

the product is not available / in stock; your billing information is not correct or not verifiable; your order is flagged up by our security systems as an unusual order or an order susceptible to fraud; your bank transfer payment is not received within 2 calendar days after acceptance of your order; we have reason to believe you are under 16; we have reason to believe that you are a reseller; there was an error in the price displayed on the Website; we could not deliver to the address provided by you; in the event of misspelling, pricing or other errors or mistakes in the Website information.

  • When you send us your order, we may run some checks on it before it is fulfilled. These checks may include verifying your address, creditworthiness, and checking for fraud. As to the latter: we run partly automated checks on all purchases to filter out unusual or suspect transactions, or transactions which can be identified as susceptible to fraud.
